Kashmir University Faces Rs. 1 Lakh Penalty For Wrong Evaluation
The High Court has imposed a fine of one lakh rupees on Kashmir University for its mishandling of Abdul Basit’s examination results. Basit, a student of B.A. 5th Semester, was initially marked as failed in the General English Paper, despite securing 27 marks out of 38 pass marks.
Upon review, it was discovered that one of Basit’s answer sheet questions hadn’t been evaluated, prompting him to request a re-evaluation. The re-evaluation showed Basit had actually scored 40 marks. However, the University scaled this down to 34 marks based on a rule, resulting in Basit failing the paper once again.
Justice Javed Iqbal Wani, in response to Basit’s plea, highlighted the University’s clear wrongdoing and ordered compensation. The court recognized that while Basit’s actual loss couldn’t be quantified, damages under Public Law were warranted.
The court criticized the University for its erroneous application of rules, forcing Basit to reappear for the exam despite his marks upon re-evaluation. The judgment mandates the University to compensate Basit with one lakh rupees within four weeks, with an additional 6% interest per annum for delays.
This ruling underscores the importance of fair evaluation processes and accountability within educational institutions.
